Purpose:
Establish levels of environmental impact due to pre-existing contamination.
Description of Service:
If the Phase II ESA results identify the presence of contaminants above Michigan Department of Environment, Great Lakes and Energy (EGLE), Generic Cleanup Criteria (GCC) or Site-specific Criteria, a BEA must be completed within 45 days of ownership acquisition or operation and disclosed to EGLE. The purpose of the BEA is to present sufficient information about the property to allow any new releases to be distinguished from existing environmental impacts and to protect the new owner/ operator from environmental liability for pre-existing contamination. The BEA provides exemption from environmental liability for pre-existing contamination.
